1. Acceptance of Terms
By accessing or using the Hostizzy booking platform at book.hostizzy.com ("the Platform"), operated by Hostsphere India Private Limited("Company", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
2. Service Description
Hostizzy is a direct booking platform for vacation rentals, homestays, villas, and managed properties across India. The Platform enables guests to browse properties, make reservations, process payments, and communicate with property managers.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.
3. Booking Terms
- All bookings are subject to availability and confirmation by the property manager.
- You must provide accurate personal information when making a booking. False or misleading information may result in cancellation without refund.
- A booking is confirmed only after successful payment and receipt of a booking confirmation via email or WhatsApp.
- Check-in and check-out times are specified on the property listing. Early check-in or late check-out may be available upon request and may incur additional charges.
- The maximum number of guests must not exceed the capacity listed for the property. Additional guests may be permitted at the discretion of the property manager with applicable surcharges.
- You must be at least 18 years of age to make a booking.
4. Pricing and Payment
- All prices displayed on the Platform are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
- Payments are processed securely through Razorpay. We accept UPI, net banking, credit cards, debit cards, and other methods supported by Razorpay.
- Full payment or a deposit (as specified on the listing) is required at the time of booking to secure your reservation.
- Additional charges (e.g., extra guests, damages, extended stay) may be collected separately during or after your stay.
- We do not store your complete payment card details. All payment data is handled by Razorpay in accordance with PCI-DSS standards.
5. Cancellation and Refunds
Cancellations and refunds are governed by our Cancellation & Refund Policy. By making a booking, you agree to the cancellation terms applicable to your reservation.
6. Guest Obligations
- Treat the property and its contents with care. You are responsible for any damage caused during your stay beyond normal wear and tear.
- Comply with house rules provided by the property manager, including rules regarding noise, smoking, pets, and events.
- Provide valid government-issued identification at check-in as required by Indian law.
- Do not engage in any illegal, harmful, or disruptive activity on the property premises.
- Report any maintenance issues or safety concerns to the property manager promptly.
7. Limitation of Liability
Hostsphere India Private Limited acts as a platform connecting guests with property managers. To the fullest extent permitted by law:
- We are not liable for the condition, safety, or suitability of any listed property.
- We are not responsible for personal injury, loss of belongings, or damages arising during your stay, except where caused by our gross negligence.
- Our total liability to you for any claim arising from the use of the Platform shall not exceed the amount paid by you for the relevant booking.
- We do not guarantee uninterrupted or error-free availability of the Platform.
8. Intellectual Property
All content on the Platform, including text, images, logos, graphics, software, and the Hostizzy brand, is the property of Hostsphere India Private Limited or its licensors and is protected by Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.
9. User Content
By submitting reviews, photos, or other content through the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce such content in connection with operating and promoting our services. You represent that you own or have the necessary rights to submit such content.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
11. Dispute Resolution
If you have a dispute regarding a booking or our services, please contact us first at stay@hostizzy.com. We will make reasonable efforts to resolve disputes amicably within 30 days.
If a resolution cannot be reached, disputes shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in New Delhi.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
